Nature of the Investment

This investment constitutes the purchase of a note secured by a deed of trust or mortgage on a specific piece of real estate as described in the Specific Disclosure Statement that would accompany that particular investment. The borrower agrees to pay a certain sum of money as stated in the note until the loan is paid in full. The note is secured by a deed of trust or mortgage on teh property which is recorded with the Public Trustee (or equivalent) of the county in which the property is located. Once a loan is paid off, the person holding the note must authorize the release of the deed of trust or mortgage from the property. If the seller of the note does not provide the investor with a title policy, the investor is encouraged to undertake an independent title search of the property which is the subject of the investment so the investor can verify title and the terms and conditions of encumbrances against the property. The title policy provides information pertaining to the present encumbrances on the property, such as the first deed of trust or mortgage, second deed of trust or mortgage, and other liens against the property and/or judgements against the borrower. It also insures the investor of the position on the property that has been agreed to with the borrower. The position is also indicated on the Specific Disclosure Statement that would be attached describing the specific property.
